    RESUMEN: La presente investigación se fundamenta en el estudio de el saneamiento por evicción en la partición de bienes, como garantía de aquellos que en conjunto aceptaron herencia, primero debe manifestarse que, si bien se regulo en nuestro ordenamiento Civil, se denota una deficiencia en la práctica jurídica esta garantía es poco recurrida en los procesos civiles, por eso se analizan el efecto que provoca que aquellos que sufren una perdida por evicción no recuren a un saneamiento. La garantía de saneamiento por evicción, es obligatoria que se incluya en toda partición de herencia, para poder amparar el dominio heredado, y que los que en conjunto la hicieran deberán en caso de alguno sufra evicción, responder de forma prorrata y hacer cesar la molestia que se sufra. ABSTRACT: The present investigation is based on the study of the sanitation by eviction in the partition of assets, as a guarantee of those who jointly accepted inheritance, it must first be stated that although it is regulated in our Civil Code, a deficiency in legal practice is denoted. This guarantee is rarely used in civil proceedings, which is why the effect that causes those who suffer a loss due to eviction not to resort to sanitation is analyzed. The guarantee of sanitation by eviction, it is mandatory that it be included in all partition of inheritance, to be able to protect the inherited domain, and that those who jointly made it must, in the event that someone suffers eviction, respond pro rata and make the nuisance cease let it suffer
