    El acceso a la justicia civil para las personas de escasos recursos en las acciones ejecutivas

    El presente trabajo de investigación aborda el problema del acceso a la justicia civil para personas de escasos recursos en El Salvador, identificando los principales obstáculos estructurales, normativos e institucionales que impiden el ejercicio pleno de este derecho fundamental. Aunque el marco legal salvadoreño (a través de la Constitución, el Código Procesal Civil y Mercantil, y tratados internacionales ratificados por el Estado) reconoce la gratuidad y universalidad del acceso a la justicia, en la práctica persisten múltiples barreras económicas, geográficas, culturales y educativas que excluyen a vastos sectores de la población, particularmente aquellos en situación de pobreza o vulnerabilidad social. La investigación examina el funcionamiento del sistema judicial salvadoreño en materia civil, así como el papel que desempeñan instituciones como la Procuraduría General de la República (PGR) y las clínicas jurídicas universitarias, las cuales ofrecen representación y asesoría legal gratuita. Sin embargo, se identifica que dichos servicios son insuficientes frente a la alta demanda y presentan una cobertura territorial limitada, lo que obliga a muchas personas a enfrentar sus procesos sin defensa técnica o a desistir de ejercer sus derechos por razones económicas. Este estudio busca contribuir a una reflexión crítica sobre la justicia como instrumento de inclusión social y propone recomendaciones concretas para garantizar el acceso real, efectivo y digno de todas las personas a la justicia civil, sin importar su condición económica. This research paper addresses the problem of access to civil justice for low-income people in El Salvador, identifying the main structural, regulatory and institutional obstacles that prevent the full exercise of this fundamental right. Although the Salvadoran legal framework -through the Constitution, the Code of Civil and Commercial Procedure, and international treaties ratified by the State- recognizes free and universal access to justice, in practice multiple economic, geographic, cultural and educational barriers persist that exclude vast sectors of the population, particularly those in situations of poverty or social vulnerability. The research examines the functioning of the Salvadoran judicial system in civil matters, as well as the role played by institutions such as the Attorney General’s Office (PGR) and university legal clinics, which offer free legal representation and advice. However, these services are insufficient to meet the high demand and have limited territorial coverage, which forces many people to face their processes without technical defense or to desist from exercising their rights for economic reasons. This study seeks to contribute to a critical reflection on justice as an instrument of social inclusion and proposes concrete recommendations to guarantee real, effective and dignified access to justice for all persons.
