Abstract
RESUMEN
El presente trabajo de investigación se basa en el estudio específico de “La Prescripción Extintiva y la Caducidad de las acciones en el derecho civil salvadoreño" y el conocimiento específico de los plazos con los que se cuentan para poder activar el órgano judicial para hacer efectivo el reclamo de sus derechos, así como el tiempo de inactividad que se tiene en la caducidad. OBJETIVOS: El objetivo general de la investigación es analizar la configuración jurídica de la prescripción extintiva y la caducidad en la legislación civil de El Salvador, para determinar el impacto que su ambigüedad normativa genera en la seguridad jurídica y el debido proceso. Los objetivos específicos incluyen, el identificar los criterios jurisprudenciales emanados de la Sala de lo Civil de la Corte Suprema de Justicia sobre la distinción entre prescripción y caducidad, con el fin de establecer su aplicación en la práctica
judicial actual, así como examinar las consecuencias procesales de la falta de regulación de la caducidad, específicamente en lo relativo a la interrupción de plazos y la facultad del juzgador para declarar la extinción de derechos de oficio. METODOLOGÍA: La investigación se llevará a cabo mediante un enfoque cualitativo, que incluyó la revisión de la normativa vigente, análisis de literatura doctrinaria y jurisprudencial. Se realizará un estudio comparativo para identificar las variaciones en la interpretación y aplicación de la prescripción extintiva en diferentes contextos, así como la caducidad de las acciones lo que permitió obtener una comprensión más profunda de sus formas de operar en la práctica judicial. CONCLUSIONES: La prescripción castiga la inactividad del acreedor extinguiendo la acción, mientras la caducidad elimina el derecho por agotamiento del plazo. En El Salvador, urge una reforma que sistematice la caducidad para garantizar certeza y seguridad jurídica.
ABSTRACT
This research is based on the specific study of "The Statute of Limitations and Expiration of Actions in Salvadoran Civil Law" and the specific understanding of the time limits used to activate the judicial system and enforce the claim of rights, as well as the period of inactivity that must expire. OBJECTIVES: The general objective of this research is to analyze the legal framework of the statute of limitations and expiration in Salvadoran civil law, in order to determine the impact of its normative ambiguity on legal certainty and due process. Specific objectives include identifying the jurisprudential criteria issued by the Civil Chamber of the Supreme Court of Justice regarding the distinction between the statute of limitations and expiration, in order to establish their application in current judicial practice, as well as examining the procedural consequences of the lack of regulation of expiration, specifically in relation to the interruption of time limits and the judge's power to declare the extinction of rights ex officio. METHODOLOGY: This research will be conducted using a qualitative approach, including a review of current regulations and an analysis of doctrinal andjurisprudential literature. A comparative study will be carried out to identify variations in the interpretation and application of the statute of limitations in different contexts, as well as the expiration of legal actions, allowing for a better understanding of their operation in judicial practice. CONCLUSIONS: The statute of limitations penalizes the creditor's inactivity by extinguishing the action, while expiration eliminates the right due to the lapse of time. In El Salvador, there is an urgent need for a reform that systematizes expiration to guarantee legal certainty.
