dc.descriptionEl presente trabajo de investigación se especifica en la Aceptación de Herencia Yacente vía Judicial, haciendo énfasis en como la herencia se constituye como un derecho real y como guarda relación con las deudas hereditarias, además también se hace mención de los requisitos para promover dicho proceso y el trámite procesal que se debe realizar.
dc.description.abstractRESUMEN La Aceptación de Herencia Yacente nace para proteger el patrimonio, esta relacionado directamente con el derecho de Herencia, como un Derecho Real también con las Deudas Hereditarias. Es por esta razón que este trabajo de investigación está encaminado a un análisis desde el nacimiento de la herencia como un derecho, de que forma este se configura como un derecho real, que ámbitos configuran a la herencia en sus diferentes tipos, como nace la herencia yacente y que impacto tiene esta en la administración de los bienes del causante. Se hace referencia de igual forma en las teorías que impulsan a la Herencia Yacente como un medio de protección del patrimonio, así como también un medio de adquisición tanto de los bienes como de las obligaciones, se hace un análisis en como el heredero no solamente adquiere los bienes, si no que se obliga con ellos y este carácter universal es lo que convierte a la herencia en un Derecho Real. De igual forma se estudia la configuración de las normas que establecen la aceptación de herencia Yacente, haciendo un análisis de lo dispuesto dentro del Código Civil de El Salvador, así como también se estudian los requisitos y el proceso legal desde donde empieza la herencia Yacente hasta donde termina y como esta se convierte en el protector del patrimonio hasta que el heredero pueda disponer de ellos libremente. ABSTRACT The Acceptance of Inheritable Estate arises to protect the heritage; it is directly related to the right of inheritance, as a Real Right also concerning Inherited Debts. This is why this research work is aimed at an analysis from the birth of inheritance as a right, how it is configured as a real right, what areas configure inheritance in its different types, how inheritable estate arises, and what impact this has on the administration of the decedent's assets. It is similarly referred to in the theories that promote the Yacente Inheritance as a means of protecting the estate, as well as a means of acquisition of both assets and obligations. An analysis is made of how the heir not only acquires the assets but is also bound by them, and this universal character is what makes inheritance a Real Right. Similarly, the configuration of the norms establishing the acceptance of dormant inheritance is studied, analyzing the provisions within the Civil Code of El Salvador, as well as the requirements and legal process from the moment the dormant inheritance begins to where it ends, and how it becomes the protector of the estate until the heir can freely dispose of it.
