dc.description.abstractSe realizó la investigación con el fin de entender los contratos civiles celebrados en documentos privados y su fuerza probatoria dentro del proceso civil y mercantil en El Salvador, se presenta de forma breve su origen histórico, la diferencia con los documentos públicos y el papel de la intervención notarial, mediante la cual ciertos documentos privados pueden adquirir carácter público al ser reconocidos ante notario. Asimismo, se realizó una separación entre documentos privados sin intervención notarial y aquellos que sí la tienen, para explicar sus diferencias y efectos jurídicos. La investigación se desarrolló con un enfoque analítico basado en doctrina, legislación y jurisprudencia nacional, y se concluye que, aunque carecen de fe pública, los documentos privados pueden producir prueba plena si no son impugnados o si se demuestra su autenticidad, y que bajo ciertos requisitos pueden alcanzar el mismo valor que un instrumento público. The investigation was carried out in order to understand civil contracts concluded in private documents and their evidentiary force within the civil and commercial process in El Salvador, their historical origin is briefly presented, the difference with public documents and the role of notarial intervention, through which certain private documents can acquire a public character when recognized before a notary. Likewise, a separation was made between private documents without notarial intervention and those that do have it, to explain their differences and legal effects. The investigation was developed with a dogmatic and analytical approach based on doctrine, legislation and national jurisprudence, and it is concluded that, although they lack public faith, private documents can produce full proof if they are not challenged or if their authenticity is demonstrated, and that under certain requirements they can achieve the same value as a public instrument.
