Abstract
RESUMEN: En la presente investigación, está orientado al cumplimiento de las garantías procesales en el marco de la LEIV. Es importante mencionar que estas garantías que tienen las mujeres al enfrentar un proceso de violencia de género están contempladas en el Art. 57 de la ley especial integral para una vida libre de violencia y discriminación para las mujeres. Estas garantías que poseen las mujeres son muy importantes, pero con la presente investigación se pretende determinar si se cumplen a cabalidad o no se cumplen, y cuáles son las medidas o políticas que implementa el Estado para que se cumplan las mismas. Desde este punto de vista la investigación, está compuesta de diferentes capítulos con la información necesaria con lo que se pretende un buen desarrollo del tema objeto de estudio, los cuales están comprendidos de la siguiente manera: en el Capítulo I, el planteamiento del problema y la Justificación del mismo; el Capítulo II, está referido al marco teórico, en el cual se tiene, la evolución del derecho de las mujeres a lo largo de la historia y el reconocimiento que ha tenido en las Ciencias Jurídicas por medio de la cual se plasma las diferentes concepciones del tema objeto de estudio, y la base legal que es de vital importancia, en la cual se fundamentan las garantías procesales de la mujer; Capítulo III, se refiere al análisis e interpretación de datos que se obtiene, donde se presentan las hipótesis, tipo de investigación y los métodos, técnicas e instrumentos de investigación; y en el Capítulo IV, se encuentra la etapa donde se conocen las conclusiones a las que se obtuvo con lo indagado, y las respectivas recomendaciones.
ABSTRACT: In the present investigation, it is oriented to the fulfillment of the procedural guarantees within the framework of the LEIV. It is important to mention that these guarantees that women have when facing a process of gender violence are contemplated in Article 57 of the special comprehensive law for a life free of violence and discrimination for women. These guarantees that women have are very important, but this research aims to determine whether they are fully complied with or not, and what are the measures or policies implemented by the State to ensure that they are complied with. From this point of view, the research is composed of different chapters with the necessary information with which a good development of the subject under study is intended, which are understood as follows: in Chapter I, the statement of the problem and the Justification of the same; Chapter II refers to the theoretical framework, in which the evolution of women's rights throughout history and the recognition it has had in the Legal Sciences through which the different conceptions of the subject under study, and the legal basis that is of vital importance, on which the procedural guarantees of women are based; Chapter III, refers to the analysis and interpretation of data obtained, where the hypotheses, type of research and research methods, techniques and instruments are presented; and in Chapter IV, there is the stage where the conclusions obtained with the investigated, and the respective recommendations are known.
