dc.description.abstractRESUMEN: El presente trabajo de investigación aborda de manera integral el contrato de compraventa dentro del derecho civil, analizando sus elementos esenciales, requisitos de validez, efectos jurídicos y principales modalidades reconocidas por la normativa. Se parte del estudio del consentimiento, el objeto y el precio como pilares fundamentales para la perfección del contrato, destacando la importancia de que estos elementos sean determinados o determinables para garantizar la seguridad jurídica en las relaciones contractuales. Asimismo, se examinan las obligaciones que surgen para las partes, especialmente las del vendedor, como la entrega o tradición de la cosa y el saneamiento por evicción y vicios ocultos, así como las del comprador, centradas principalmente en el pago del precio en las condiciones pactadas. El análisis también incluye figuras relevantes como las arras, la retroventa y las ventas de cosas futuras, las cuales reflejan la flexibilidad del contrato frente a distintas necesidades prácticas. Desde una perspectiva doctrinaria y jurídica, se estudian los límites legales del objeto del contrato, las consecuencias del incumplimiento y los mecanismos de protección para ambas partes, incluyendo acciones como la resolución del contrato y la acción redhibitoria. De igual forma, se incorpora una visión crítica basada en la interpretación normativa y su aplicación práctica. En conjunto, la investigación permite comprender la compraventa no solo como un acto jurídico, sino como una institución esencial en la dinámica económica, resaltando su relevancia en la transferencia de bienes y en la regulación de las relaciones patrimoniales. ABSTRACT: This research work comprehensively addresses the contract of sale within civil law, analyzing its essential elements, validity requirements, legal effects, and main modalities recognized by the legal framework. It begins with the study of consent, object, and price as fundamental pillars for the formation of the contract, highlighting the importance that these elements be determined or determinable in order to ensure legal certainty in contractual relationships. Likewise, the obligations arising for the parties are examined, especially those of the seller, such as the delivery or transfer of the good and the warranty against eviction and hidden defects, as well as those of the buyer, primarily focused on the payment of the price under the agreed conditions. The analysis also includes relevant figures such as earnest money, repurchase agreements, and the sale of future goods, which reflect the flexibility of the contract in response to different practical needs. From a doctrinal and legal perspective, the study explores the legal limits of the object of the contract, the consequences of non-compliance, and the protection mechanisms available to both parties, including actions such as contract termination and the redhibitory action. It also incorporates a critical perspective based on normative interpretation and its practical application. Overall, this research allows for an understanding of the contract of sale not only as a legal act, but as an essential institution within economic dynamics, highlighting its relevance in the transfer of goods and in the regulation of patrimonial relationships.
