Item La suspensión condicional del procedimiento en la Legislación Penal Salvadoreña(FMO, UES, 2003-01-01) Alberto Paredes, Juan Francisco; Canales Molina, Robin Erlich; Quintanilla Flores, Julio César; Solórzano Trejo Gómez, Carlos; González, Marvin WilliamEl Comité del Octavo Congreso de las Naciones Unidas sobre prevención del delito y prevención del delincuente (celebrado en La Habana Cuba, del 27 de Agosto al 7 de Septiembre de 1990) tras arduos debates, los participantes estuvieron de acuerdo en sancionar las Reglas Mínimas de las Naciones Unidas sobre las Medidas no Privativas de Libertad, denominadas Reglas de Tokio. Esta situación ha llevado a muchos países a modificar sus normativas penales y procesales, las cuales están mas acorde a la realidad y que responden a las exigencias internacionales. Para El Salvador el año de 1998 marca un cambio considerable en la legislación penal y procesal penal, esto trae consigo implicaciones desde muchos puntos de vistas; uno de ellos el conocimiento que se debe tener sobre los nuevos institutos jurídicos regulados en la normativa expresada. Un instituto jurídico que se introduce como novedad en el sistema penal salvadoreño es la Suspensión Condicional del Procedimiento, regulado en el artículo 22 y siguientes del Código Procesal Penal como salida alternativa al proceso y que de cumplirse efectivamente con los requisitos y preceptos que este implica, produce la extinción penal. Esta salida alterna al proceso no solamente pretende descongestionar el sistema penal en cuanto a la rápida sustanciación de los procesos sino crear una conciencia en la sociedad para que comprenda que la actividad punitiva del Estado tiene como fin único castigar al infractor del ordenamiento jurídico; mas bien educarlo y readaptarlo, teniendo un mecanismo que impide que ingrese a un centro penitenciario
